Welcome to Whispa. These Terms of Service ("Terms") govern your use of our mobile application and related services. By accessing or using Whispa, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our service.

1. Eligibility

By using Whispa, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into this agreement
• You are not prohibited by law from using the service
• You will comply with all applicable laws and regulations

2. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information during registration
• Notify us immediately of any unauthorized access to your account
• Not share your account credentials with others
• Not create multiple accounts for deceptive purposes

3. User Conduct and Community Standards

You agree not to use Whispa to:

• Harass, bully, threaten, or abuse other users
• Post hate speech, discriminatory content, or bigotry
• Share sexual, explicit, or exploitative content
• Promote violence or self-harm
• Engage in illegal activities or promote illegal content
• Spam, phish, or distribute malware
• Impersonate others or misrepresent your identity
• Violate intellectual property rights
• Circumvent security measures or access unauthorized areas

Zero Tolerance Policy: Whispa maintains a strict zero-tolerance policy for violations of these standards. Violations will result in immediate account suspension or permanent ban.

4. Content Ownership and Rights

You retain ownership of content you create and post on Whispa. By posting content, you grant Whispa a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute your content for the purpose of operating and improving the service.

You represent and warrant that you own or have the necessary rights to all content you post and that your content does not violate any third-party rights.

5. Reporting and Moderation

Whispa provides tools to report inappropriate content and block users. We review reports and take appropriate action, which may include:

• Removing content that violates our standards
• Suspending or terminating user accounts
• Cooperating with law enforcement when necessary

We reserve the right to moderate content and enforce community standards at our sole discretion.

6. In-App Purchases and Coins

Whispa offers in-app purchases of virtual currency ("Coins") that can be used to access certain features. You agree that:

• Coins are virtual currency with no real-world value
• Coins are non-refundable except as required by law
• Coins cannot be transferred or exchanged for cash
• We may modify or discontinue Coins at any time
• Unused Coins may be forfeited upon account deletion

7. AI Encouragement Companion

The AI Encouragement Companion is designed to provide supportive conversation and encouragement only. You acknowledge that:

• The AI Companion is not a medical professional or therapist
• The AI Companion cannot diagnose, treat, or prevent any disease or condition
• The AI Companion does not provide medical advice
• You should not rely on the AI Companion for medical decisions
• If you have concerns about your well-being, consult a qualified medical professional

8. Limitation of Liability

To the fullest extent permitted by law, Whispa and its creators, owners, and operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

9. Disclaimer of Warranties

Whispa is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless Whispa and its creators, owners, and operators from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to Whispa at any time, with or without cause, and with or without notice. Upon termination, your right to use the service ceases immediately.

12. Modifications to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page. Your continued use of Whispa following the posting of revised Terms means that you accept and agree to the changes.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
